Talak ki haqiqat
ALLAH ke nabi sallallahu alaihi wasallam ne farmaya ki ALLAH tala ko margub chijo me sabse na
pasnd chij talak ka dena hai ,,
isako na pasand karate hain islaam mein bhee yah ek buree
baat samajhee jaatee hai lekin isaka matalab yah haragiz
nahin ki talaaq ka hak hee insaanon se chheen liya jae,
pati patnee mein agar kisee tarah bhee nibaah nahin ho pa
raha hai to apanee zidagee jahannam banaane se bahatar hai
ki vo alag ho kar apanee zindagee ka safar apanee
marzee se poora karen jo ki insaan hone ke naate unaka
hak hai, isee lie duniyaan bhar ke kaanoon mein talaaq kee
gunjaish maujood hai. aur isee lie paigambaron ke deen
(dharm) mein bhee talaaq kee gunjaish hamesha se rahee hai.
deene ibraaheem kee rivaayaat ke mutaabik arab jaahiliyat ke daur
mein bhee talaaq se anajaan nahin the, unaka itihaas
bataata hai ki talaaq ka kaanoon unake yahaan bhee lagabhag
vahee tha jo ab islaam mein hai lekin kuchh bidaten
unhonne isamen bhee daakhil kar dee thee.kisee jode mein
talaak kee naubat aane se pahale har kisee kee yah
koshish honee chaahie ki jo rishte kee dor ek baar
bandh gaee hai use mumakin had tak tootane se bachaaya
jae,
jab kisee pati-patnee ka jhagada
badhata dikhaee de to Allah ne kuraan mein unake kareebee rishtedaaron aur
unaka bhala chaahane vaalon ko yah hidaayat dee hai ki
vo aage badhen aur maamale ko sudhaarane kee koshish karen
isaka tareeka kuraan ne yah batalaaya hai ki “ek
phaisala karane vaala shohar ke khaanadaan mein se mukarrar karen
aur ek phaisala karane vaala beevee ke khaanadaan mein se
chune aur vo donon jaj mil kar uname sulah karaane kee
koshish karen, isase ummeed hai ki jis jhagade ko pati
shohar beevee mein phoot pad jaane
♥ quraan ne ise kuchh yoon bayaan kiya hai
“aur agar tumhe shohar beevee mein phoot pad jaane kaandesha ho to ek hakam (jaj) mard ke logon mein se
aur ek aurat ke logon mein se muqarrar kar do, agar
shohar beevee donon sulah chaahenge to allaah unake beech
sulah kara dega, beshak allaah sab kuchh jaanane vaala
aur sab kee khabar rakhane vaala hai”
[surah nisa 35 ]
isake baavajood bhee agar shohar aur beevee donon ya
donon mein se kisee donon mein se kisee ek ne talaak ka phaisala kar hee liya
hai to shauhar beevee ke khaas dinon (menstrueshan)ke aane ka intizaar kare, aur khaas dinon ke
guzarjaane ke baad jab beevee paaq ho jae to bina ham bistar hue kam se kam do jummedaar logon
ko gavaah bana kar unake saamane beevee ko ek talaak de, yaani shohar beevee se sirph itana kahe ki
”main tumhe talaak deta hoon”.
talaak har haal mein ek hee dee jaegee
hadees ; syedna abbas radiallahu talaanhu se riwayat hai ki NAbi karim sallallahu alaihi wasallam
ke waqat aur abu bakar radiallahu talaanhu ke huqumat me aur umr radiallahu talaanhu ke huquqmt
me bhi pahlye 2 yers [saal ] tak yesa tha ki jab koi ekbar hi 3 talak deta tha to wo ek hi gina jata tha
, fir syedna umr radiallahu talaanhu ne kaha ki is baat me logo ne jaldi karna shuru ki hai , jisme inhe
mohlat mili hai , bas agr ham isko zari karde to munasib hai fir unhone zari kar diya , fir yae huqum
zari kar diya ki jo koi ek saath 3 talak de dega to wo ho jayegi ,,
me bhi pahlye 2 yers [saal ] tak yesa tha ki jab koi ekbar hi 3 talak deta tha to wo ek hi gina jata tha
, fir syedna umr radiallahu talaanhu ne kaha ki is baat me logo ne jaldi karna shuru ki hai , jisme inhe
mohlat mili hai , bas agr ham isko zari karde to munasib hai fir unhone zari kar diya , fir yae huqum
zari kar diya ki jo koi ek saath 3 talak de dega to wo ho jayegi ,,

ya sau nahin, jo log jihaalat kee haden paar karate hue
do teen ya hazaar talaak bol dete hain yah islaam ke
bilkul khilaaph amal hai aur bahut bada gunaah hai
allaah ke rasool (sallaahoo alaihi vasallam) ke pharamaan
ke mutaabik jo aisa bolata hai vo islaamee sharyat
aur kuraan ka mazaak uda raha hota hai.
iddat kaha jaata hai
is ek talaak ke baad beevee 3 maheene yaani 3 teen
haiz (jinhen iddat kaha jaata hai aur agar vo pregnent hai to bachcha hone) tak shohar hee ke ghar
rahegee aur usaka kharch bhee shohar hee ke jumme rahega lekin unake
bistar alag rahenge, kuraan ne sooreh talaak mein hukm
faramaaya hai ki iddat pooree hone se pahale na to beevee ko
sasuraal se nikaala jae aur na hee vo khud nikale,
isakee vajah kuraan ne yah batalaee hai ki isase ummeed
hai ki iddat ke dauraan shohar beevee mein sulah ho jae aur
vo talaak ka phaisala vaapas lene ko taiyaar ho jaen.

Ruzu karna
akl kee raushanee se agar is hukm par gor kiyajae to maaloom hoga ki isamen badee achchhee hikamat hai,
har maaashare(samaaj) mein beech mein aaj bhadakaane vaale log
maujood hote hee hain, agar beevee talaak milate hee apanee
maan ke ghar chalee jae to aise logon ko donon taraph kaan
bharane ka mauka mil jaega, isalie yah zarooree hai ki
beevee iddat ka vaqt shohar hee ke ghar guzaare
phir agar shohar beevee mein iddat ke dauraan sulah ho jae
to phirase vo donon bina kuchh kiye shohar aur beevee kee
hesyat se rah sakate hain isake lie unhen sirph itana
karana hoga ki jin gavaahon ke saamane talaak dee thee
unako khabar karaden ki ham ne apana phaisala badal liya
hai, kaanoon mein ise hee ”rujoo” karana kahate hain aur yah
zindagee mein do baar kiya ja sakata hai isase jyaada

shohar rujoo na kare to iddat ke poora hone par shohar beevee
ka rishta khatm ho jaega, lihaaza kuraan ne yah
hidaayat pharamaee hai ki iddat agar pooree hone vaalee hai
to shohar ko yah phaisala kar lena chaahie ki use beevee
ko rokana hai ya rukhasat karana hai, donon hee sooraton mein
allaah ka hukm hai ki maamala bhale tareeke se kiya
ko rokane ka phaisala kiya hai to yah rokana veebee ko
pareshaan karane ke lie haragiz nahin hona chaahie balki
sirph bhalaee ke lie hee roka jae. ALLAH quran me farmate hai
aur jab tum auraton ko talaak do aur vo apanee iddat ke khaatme par pahunch jaen to ya to unhen
bhale tareeqe se rok lo ya bhale tareeqe se rukhasat kar do, aur unhen nuksaan pahunchaane ke iraade
se na roko ke unapar zulm karo, aur yaad rakho ke jo koee aisa karega vo dar hakeekat apane hee
oopar zulm dhaega, aur allaah kee aayaaton ko mazaak na banao aur apane oopar allaah kee nematon
ko yaad rakho aur us kaanoon aur hikamat ko yaad rakho jo allaah ne utaaree ha jisakee vo tumhe
naseehat karata hai, aur allaah se darate raho aur dhyaan rahe ke allaah har cheez se vaakiph hai”
[ surah bakrah 231]
talaaqlekin agar unhonne iddat ke dauraan rujoo nahin kiya aur iddat ka vaqt khatm ho gaya to ab
unaka rishta khatm ho jaega, ab unhen juda hona hai.is maukepar kuraan ne kam se kam do jagah
(sooreh bakraah aayat 229 aur sooreh nisa aayat 20 mein) is baat par bahut zor
diya hai ki mard ne jo kuchh beevee ko pahale gahane, keematee saamaan, roopaye ya koee jaedaad
tohaphe ke taur par de rakhee thee usaka vaapas lena shohar ke lie bilkul jaayaz nahin
hai vo sab maal jo beevee ko talaak se pahale diya tha vo ab bhee beevee ka hee rahega aur vo us
maal ko apane saath lekar hee ghar se jaegee, shohar ke lie vo maal vaapas maangana ya lena ya
beevee par maal vaapas karane ke lie kisee tarah ka dabaav banaana bilkul jaayaz nahin
hai.
not agar beevee ne khud talaak
maangee thee jabaki shohar usake saare hak sahee se ada kar raha tha ya beevee khulee
badakaaree par utar aaee thee jisake baad usako beevee banae rakhana mumakin nahin raha tha to
mahar ke alaava usake die hue maal mein se kuchh ko vaapas maangana ya lena shohar ke lie jaayaz
hai.)ab isake baad beevee aazaad hai vo chaahe jahaan jae aur jisase chaahe shaadee kare, ab pahale
shohar ka us par koee hak baaki nahin raha.isake baad talaak dene vaala mard aur aurat jab kabhee
zindagee mein dobaara shaadee karana chaahen to vo kar sakate hain isake lie unhen aam nikaah kee
tarah hee phirase nikaah karana hoga aur shohar ko mahar dene honge aur beevee ko mahar lene
honge.
# ab farz karen ki
doosaree baar nikaah karane ke baad talak
kuchh samay ke baad uname phirase jhagada ho jae aur
uname phirase talaak ho jae to phir se vahee poora proses
doharaana hoga jo mainne oopar likha hai,
jo aurat bina koee khaas vajah ke shohar se talaak maange
to us par jannat kee khushabu haraam hai.

ab farz karen ki doosaree baar bhee talaak ke baad vo donon
aapas mein shaadee karana chaahen to sharayat mein teesaree baar bhee
unhen nikaah karane kee ijaazat hai. lekin ab agar unako
talaak huee to yah teesaree talaak hogee jis ke baad na to
rujoo kar sakate hain aur na hee aapas mein nikaah kiya ja
sakata hai.
Halala kiaya hai aur uska triqa
# ab chauthee baar unakee aapas mein nikaah karane kee koee
gunjaish nahin lekin sirph aise ki apanee aazaad marzee se
vo aurat kisee dusare mard se shaadee kare aur ittiphaaq se
unaka bhee nibha na ho sake aur vo doosara shohar bhee use
talaak dede ya mar jae to hee vo aurat pahale mard se
nikaah kar sakatee hai, isee ko kaanoon mein ”halaala” kahate hain.
lekin yaad rahe yah ittifaak se ho to jaayaz hai jaan
boojh kar ya plaan bana kar kisee aur mard se shaadee karana
aur phir usase sirph is lie talaak lena taaki pahale
shohar se nikaah jaayaz ho sake yah saajish saraasar
naajaayaz hai aur allaah ke rasool (sallallaahu alaihi
wasallam) ne aisee saajish karane vaalon par laanat pharamaee hai.
khula kise kahte hai
agar sirph beevee talaak chaahe to use shohar se talaak maangana
hogee, agar shohar nek insaan hoga to zaahir hai vo beevee
ko samajhaane kee koshish karega aur phir use ek talaak
de dega, lekin agar shohar maangane ke baavajood bhee talaak
nahin deta to beevee ke lie islaam mein yah aasaanee rakhee
gaee hai ki vo shahar kaazee (jaj) ke paas jae aur usase
shohar se talaak dilavaane ke lie kahe, islaam ne kaazee
ko yah haq de rakha hai ki vo unaka rishta khatm karane
ka ailaan kar de, jisase unakee talaak ho jaegee, kaanoon
mein ise ”khula” kaha jaata hai.yahee talaak ka sahee tareeka
hai lekin afasos kee baat hai ki hamaare yahaan is tareeke
kee khilaaph varjee bhee hotee hai aur kuchh log bina soche
samajhe islaam ke khilaaph tareeke se talaak dete hain jisase
khud bhee pareshaanee uthaate hain aur islaam kee bhee badanaamee
hotee hai.

talak de diya to usne syedna abdul rahman bin zabir radiallahu talaanhu se nikah kar li fir nabi karim
sallallahu alaihi wasallam ke paas aakr astgfar kiya ki ya rasulallah main rafiya radi allahuanhuma ke
aqd nikah me thi us ne mujeh 3 me se aakhiri talak de di to main ne abdul rahman bin
zabir radiallahu talaanhu se nikah kar li aur main apni chadr ka ek pallu pakdh kar kahne lagi
ALLAH ki kasam un ke paas to kapdeh ki pallu ki tarah hi hai rawi ne kaha ki nabi karim sallallahu
alaihi wasallam us ki baat sun kar mushkura diye aur farmya sayd fir tum rafiya radiallahu talaanhu
ke paas lautna chahti ho yesa us waqat tak nahi ho sakta jab tak ki wo tumhari lajjat na chik le aur
tum uski lajjat na chik lo [ yani shobat ] na karlo us waqat syedna abu bakr radiallahu talaanhu nabi
karim sallallahu alaihi wasallam ke paas baithe hue thye aur khalid bin sayeed bin aas radiallahu
talaanhu hizar ke darwaze par izazat ke munjar thye rawi kahta hai ki syedna khalid radiallahu
talaanhu ne syedna abu bakr radiallahu talaanhu ko aawaz di ki aap us aworat ko dante kiyo nahi ho
ki yae nabi karim sallallahu alaihi wasallam se kiya kah rahi hai ,,
talak de diya to usne syedna abdul rahman bin zabir radiallahu talaanhu se nikah kar li fir nabi karim
